As a personal injury attorney, I talk with auto accident and motorcycle accident victims every day. Over the past few months, I have noticed a disturbing trend. The insurance companies are trying to force people who haven’t hired an attorney to settle their cases for insultingly low amounts. Now, the fact that insurance companies are trying to take advantage of people is nothing new. However, in the past few months I have received multiple calls from accident victims who have been offered $500 to settle all of their bodily injury claims. All of these callers shared several things in common. They were in serious accidents where liability was clear, the liability was not theirs, they incurred thousands of dollars in medical bills and they had no health insurance. All of these callers, through no fault of their own, were completely upside-down financially because of their accidents. I believe that the insurance companies were trying to take advantage of these peoples’ economic distress and turn it into a huge economic windfall for themselves.
In Colorado, accident victims involved in car or motorcycle accidents are entitled to be reimbursed, at a minimum, for their medical bills, lost wages, out of pocket expenses, medical co-pays, insurance deductibles, property damage, rental car fees and pain and suffering. The insurance companies and their adjusters know that many people don’t know what their rights are, and they try and take advantage of them by lying about what the law allows and making ridiculous settlement offers.
