The Denver Post’s Accident Tips

So you have been in an automobile or motorcycle accident.  You’re hurt, your car or motorcycle is wrecked and you already have enormous medical bills.  The other driver’s insurance calls you saying that they can help but they have few questions.  And, oh by the way “do I have your permission to record this conversation?”  You just want help and the insurance adjuster seems nice so why not let them record your conversation?

Simple, because they are recording everything you say, it is like they are taking your deposition.  What does this mean?  Well, it means everything you are saying can be used against you later if the other driver’s insurance company fights you.  Contrary to what you see on tv we live in a polite society that generally tries to downplay our pain or discomfort.  Think about it.  When you are feeling sick or having a bad day and someone asks how you are doing you cheerfully reply “great!”  Put this in the context of the insurance adjuster asking you questions about your injuries or pain.  Most people say that they are doing better even though they’re not.  The insurance companies will use this against you later when you are trying to settle your claim.

So what do you do?  Do not give the other driver’s insurance company permission to record your conversation.
