For civil actions filed on or after January 1, 2025, the new bill increases the cap on damages for noneconomic loss or injury from $250,000 to $1.5 million. Starting January 1, 2028, and every two years thereafter, this cap will be adjusted based on inflation. This change ensures that the compensation for noneconomic damages keeps pace with the cost of living.

The bill also expands the scope of who may file a wrongful death lawsuit. Previously, only certain family members could bring such actions. Now, a sibling of the deceased may also bring a wrongful death action in specific circumstances. Additionally, the bill sets a wrongful death damages cap at $2.125 million, with adjustments for inflation beginning in 2028 and every two years thereafter.

For medical malpractice wrongful death claims, the damages cap will incrementally increase to $1.575 million over five years, starting January 1, 2025, and will then be adjusted for inflation every two years. Similarly, the cap on noneconomic damages in medical malpractice cases, currently set at $300,000, will incrementally rise to $875,000 over the same five-year period, with biennial adjustments for inflation following that.
