DENVER, CO – The O’Sullivan Law Firm is accepting wrongful death cases in light of recent legislative changes in Colorado. These changes, designed to expand access to justice and increase potential compensation for bereaved families, significantly impact who may file a wrongful death lawsuit and the maximum damages that can be awarded.
Under the new legislation, siblings of the deceased may now bring a wrongful death action in specific circumstances. Previously, only spouses, civil union partners, children, and other designated beneficiaries had the legal authority to seek compensation. This broader scope recognizes the important role siblings often play in familial and financial support.
For civil actions filed after January 1, 2025, the bill increases the cap on damages for noneconomic loss or injury from $250,000 to $1.5 million, and starting January 1, 2028, the bill imposes a wrongful death damages cap of $2.125 million, and every 2 years thereafter, adjusts the damages cap based on inflation.
This adjustment reflects the legislature’s acknowledgment that families who lose a loved one due to negligence or wrongdoing should receive compensation that more accurately reflects current economic realities.
For those facing the devastating loss of a loved one due to medical malpractice, the damages cap will increase to $1.575 million over five years, as of January 1, 2025, and will continue to be adjusted for inflation every two years thereafter.
The previous law limited the amount recoverable for noneconomic damages in medical malpractice actions to $300,000. As of January 1, 2025, the bill incrementally increased the noneconomic damages limitation to $875,000 over the course of 5 years. Thereafter, the cap is adjusted biennially for inflation.
